Acceptance of terms
These Terms of Service govern your use of Kickoff Quiz (the Service), including the mobile application, our website at kickoffquiz.app, and any related services. The Service is operated by Tomasz Makowski, a sole trader registered in Poland.
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use the Service.
You must be at least 13 years old to use Kickoff Quiz. If you are under 18, you confirm that you have permission from a parent or legal guardian.
Your account
- You are responsible for keeping your account credentials secure.
- You may not share your account with others, nor allow anyone else to use it.
- You are responsible for all activity that occurs through your account.
- You agree to provide accurate registration information and to keep it up to date.
- We may suspend or terminate accounts that violate these Terms — including for cheating, harassment, abuse, or attempted fraud.
Free tier
Kickoff Quiz can be used without paying. The free tier includes:
- 1 game per day at no cost — all game modes, no feature lock.
- Up to 5 additional games per day available by watching a short rewarded advertisement.
- The daily allowance resets every day at 00:00 UTC.
- Hosting an online multi-device lobby requires a Premium subscription. Joining a lobby created by a Premium host is included in the free tier.
There is no free trial for Premium subscriptions. The free tier with daily limits is the permanent free option.
Subscriptions
Premium removes daily limits and unlocks hosting of online multi-device lobbies. Three plans are available:
Billing
- Payment is processed by Apple App Store or Google Play, not directly by us. We never see your payment details.
- Monthly and Yearly plans auto-renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
- You can manage or cancel auto-renewing subscriptions in your App Store or Play Store account settings — not in the app.
- The Weekend pass is a one-time purchase, not a subscription. It does not auto-renew. You may buy it as many times as you wish.
- Prices may differ from those shown here based on your local currency and tax. The price shown by the store at checkout is binding.
Refunds
- Refunds for purchases made via App Store or Google Play are handled by the platform according to their refund policies — not directly by us.
- If your purchase is refunded by Apple or Google, your Premium access ends immediately.
- We do not offer refunds for partially-used subscription periods outside the platform refund process.
- If you are a consumer in the European Union, you may have statutory rights of withdrawal — those are not waived by these Terms.
Acceptable use
You agree not to:
- Use bots, scripts, or other automated means to interact with the Service.
- Attempt to reverse-engineer, decompile, or extract source code from the Service.
- Exploit bugs or vulnerabilities instead of reporting them.
- Harass, intimidate, or abuse other players.
- Create multiple accounts to circumvent limits, ban evasion, or commit fraud.
- Use the Service for any illegal purpose, or to transmit harmful or unlawful content.
- Attempt to gain unauthorized access to other accounts or to our infrastructure.
Violations may result in account suspension or termination without refund.
Intellectual property
- Kickoff Quiz — including the app, branding, game modes, questions, content, and code — is owned by Tomasz Makowski and protected by copyright and other intellectual property laws.
- You may not reproduce, distribute, modify, publicly display, or create derivative works of any part of the Service without prior written permission.
- Football-related facts and statistics are sourced from publicly available data and curated manually. While we strive for accuracy, occasional errors may occur.
- Your account data — username, gameplay history, and profile information — is yours. You may request a copy at any time by emailing [email protected].
Disclaimers
The Service is provided "as is" and "as available", without warranty of any kind, express or implied. We do not guarantee that:
- The Service will be uninterrupted, error-free, or available at all times.
- Game content will always be entirely accurate or up to date.
- Bugs or defects will be corrected within any specific timeframe.
- The Service will meet your specific requirements or expectations.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you have paid us in the 12 months preceding the claim, or 100 PLN, whichever is greater.
This limitation does not affect your statutory rights as a consumer under applicable mandatory law — including under EU consumer protection regulations if you are resident in the European Union.
Termination
- You may stop using the Service and delete your account at any time using the in-app Delete account control.
- We may suspend or terminate your account if you violate these Terms or for prolonged inactivity (no login for over 24 months).
- Terminated accounts forfeit any unused subscription time. We are not obligated to refund unused time.
- Upon termination, your data is handled according to the retention and deletion rules described in the Privacy Policy.
Changes to these terms
We may update these Terms from time to time. The Last updated date at the top reflects the most recent revision.
For material changes — such as new restrictions, pricing changes, or changes affecting your rights — we will notify you via in-app notification or email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Governing law & disputes
These Terms are governed by the laws of Poland, without regard to conflict-of-laws principles.
If you are a consumer resident in the European Union, mandatory consumer protection rules of your country of residence also apply, and you retain the right to bring legal proceedings in your local courts.
For consumer disputes that cannot be resolved between us directly, the European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
